The Ad Connection - Terms Of Service

By signing up and actively using TheAdConnection program you agree to all terms and conditions set forth in this agreement. TheAdConnection may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with TheAdConnection. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the TheAdConnection program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Members:
Our program is open to both US and International English speaking members and is void where prohibited by local governing laws. You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing TheAdConnection account. You will use your email address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link. You are solely responsible for any and all use of your TheAdConnection account including authorization by you to any third party individual who may use your account. TheAdConnection is an advertising program designed to cater to advertisers and members who purchase these services, Upgrades, Email Ads, Paid-to-Click Ads, Banner space, Sponsor Links, and any other available advertising needs. We ask that as long as you are a member of TheAdConnection, you remain active. No one is ever required to participate on a daily basis, however, we do require at least one click on any ad every 30 days. Members found inactive for 30 days or more will be deleted. We also ask that if you need to be away for a period of time, kindly visit your User Account to place yourself in vacation mode. Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by TheAdConnection be detected it may result in member termination and possible legal action. Any Email addresses found purposefully spamming or sending unwanted email to any admin address, will be terminated immediately. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination. You must maintain your email account that you used when signing up with TheAdConnection. You agree to receive e-mail advertising from TheAdConnection.

Cheating:
The following reasons will result in termination:
The use of Cheat software.
Members sharing identical ISPs, Computer IDs and/or Usernames.
Members found lying about their Country of origin.
Incomplete Profile information i.e. Name, address, Payment processor.
Clicking on "Cheat Links" (1 or more)
Keyword Interests: "I CHEAT" "CAN'T READ ENGLISH" "DELETE ME"
Members performing 'Searches' who live in a 'non-search' country.


Search Engine Terms:
Effective immediately, only members from Search Friendly countries may have "Search Emails" checked off as an interest. Any member found not following these terms, will be suspended until the individual account reflects a correction made by that member. In order to allow other countries to continue to search, there is an interest marked "International Searches" for your convenience.
The following countries may continue to perform Searches at Excite PTR: United States, Canada, Australia, Austria, Belgium, Denmark, Finland, France, Germany, Greece, Iceland, Italy, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, and United Kingdom.

Invalid Email Address:
In the event your e-mail account on file becomes closed or blocked to messages from TheAdConnection, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.

Relationship of the Parties:
You and TheAdConnection are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and TheAdConnection. You understand that you do not have authority to make or accept any offers or make any representations on behalf of TheAdConnection. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:
TheAdConnection will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or TheAdConnection program, even if TheAdConnection has been advised of the possibility of such damages. Furthermore, TheAdConnection aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Compensation:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by TheAdConnection. Members may earn by referring new members to the TheAdConnection program. Members will earn a percentage of advertising revenues collected by TheAdConnection. Members will be paid via PayPal. TheAdConnection will pay members when their balance reaches the minimum payout rate set by TheAdConnection. Once the member has reached payout they may request payment. Payments will be made within 30 days but usually within a week or two. Once Payment requests are received, TheAdConnection will review Member Profiles to ensure validity of Payment Processors and all other information. If you live in countries other than U.S.A., Canada, Australia, and the UK, all others must be upgraded in order to receive cash payments. How ever all countries may use earnings for advertising.

Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with TheAdConnection and may result in legal prosecution. TheAdConnection strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. TheAdConnection may charge up to $15 per spam email sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. TheAdConnection will file charges for recovery of any earnings received from multiple sign-ups.
